Last Will and Testament

I, Mr. John Peter Smith, of 123 Main Street, London, England, HEREBY REVOKE all former wills and testamentary dispositions made by me AND DECLARE this to be my last will.

1. I APPOINT my wife, Jane Smith, of 123 Main Street, London, England, to be the Executor and Trustee of this my Will, provided that there should be at all times one (1) Executor and Trustee of this my Will so that in the event that my above-named Executor and Trustee shall have predeceased me or shall survive me but die before the trusts hereof shall have terminated or shall be unable or unwilling to act or to continue to act, I appoint, in the following order of priority, such one of the persons hereinafter named as shall not already be acting and as shall be able and willing to act to fill the vacancy so created, namely, my friend, Cindy Jones, of 66 Milton Road, Apt. A-43, London, England, then my brother, James Smith, of Leeds, West Yorkshire. In this Will the expression "my Trustees" means (as the context requires) those of my Executors who obtained probate and the Trustees for the time being of any trust arising under this Will.
   
   
2. 1. If I die before my daughter, Sally Ann Smith, has attained the age of 18, then I appoint Jennifer Hastings to be the personal guardian of such child.
      
      
3. My Trustees shall hold the remainder of my estate in trust for sale on the following terms:
   
   
   1. To pay debts and funeral and testamentary expenses.
      
      
   2. To pay inheritance tax in respect of property passing under the Will.
      
      
   3. To pay, transfer, and assign the residue of my estate to my wife, Jane Smith, for her use absolutely.
