You need a Will for every country in which you hold assets.

If you have a Will, it must be validated through the process of probate in the country in which the assets are held. The probate process also grants your Executor the authority to act as your estate administrator. This allows them to gather your assets and distribute them according to the instructions in your Will. Probate happens in each country in which you hold assets, so you need a Will written under the laws of each country in which you hold assets.

  • To be a legal Will under Indian law, the document must be on paper (video or recorded intentions are not acceptable). It must then be signed by you in the presence of two adult witnesses who are not beneficiaries in the Will.
  • A Will allows you to make key appointments, like your "Executor", who has the responsibility to carry out the instructions in your Will. They must gather your estate and then distribute it. You can also name a guardian for young children in your Will.
